Software License Agreement For Nvidia Cuda Toolkit

The following CUDA Toolkit files can be distributed with license applications that you have developed, including some variants of these files whose version number or architecture-specific information is embedded in the file name – the file is cudart64_90.dll redistributable as an example of version 9.0 of the 64-bit Windows software. The SDK may be bundled with third-party software licensed from an NVIDIA vendor and/or open source software provided under an open source license, or included or distributed. Use of third-party software is subject to third-party license terms or, except, conditions, to the terms of this Agreement. Copyright in third-party software belongs to the copyright holders mentioned in the third party`s software or license. The following license limitations apply to your use of the SDK: The SDK is allowed to develop applications only for use in systems using NVIDIA GPUs. NVIDIA may, at its option, provide patches, workarounds, or other updates for this SDK. If updates are not made available with their particular terms, they will be considered part of the SDK granted to you under this Agreement. 3.1 NVIDIA or its licensors own all right, title and interest in and to the SDK and its modifications and derivative works, including their respective intellectual property rights, subject to your rights in accordance with Section 3.2. This SDK may contain software and materials from NVIDIA licensors, and such licensors are the third party beneficiaries who intend to enforce this agreement with respect to their intellectual property rights. The Chapter 1 Software License Agreement and chapter 2 supplement contain license terms governing the use of NVIDIA software.

By accepting this agreement, you agree to comply with all conditions applicable to the products included therein. In addition to the aforementioned rights, the parties that develop software exclusively for use on jetson development kits or Jetson modules and that run Linux for the Tegra software are as follows: the SDK may be distributed in its entirety, as provided by NVIDIA and without disconnection of its components, to you and/or your licensees, in order to provide software development kits for use only on the Jetson platform and on Linux for the Tegra software to create. NVIDIA Products are sold in accordance with NVIDIA`s Terms of Sale made available at the time of order confirmation, unless otherwise agreed in an individual sales agreement signed by authorized representatives of NVIDIA and customer (“Terms of Sale”). NVIDIA expressly objects to the application of Customer`s Terms and Conditions of Sale with respect to the purchase of the NVIDIA product to which this document refers. This document does not constitute, directly or indirectly, contractual obligations. 3.3 You may, but do not need to, provide NVIDIA suggestions, feature queries, or other feedback on the SDK, including any improvements or changes to the SDK. For any feedback you voluntarily provide, you grant NVIDIA and its associates a perpetual, non-exclusive, worldwide, irrevocable license to use, reproduce, modify, license, sublicense (on multiple levels of sublicenses) and distribution (on multiple levels of distributors) without payment of royalties or royalties. NVIDIA will use the feedback as it chooses.
